GENERAL TERMS OF SALES

ARTICLE 1 : APPLICATION FIELD
The present general terms of sales are applys on all sales contracted thru the website http://www.cine-scale.com or directly in our facilities, on the sales of tailor made scale models and on the sales of additionnal products offered on our website, between the company Cine-Scale hélicopters, further after named "Cine-Scale" and the customers wishing to purchase products from Cine-Scale, further after named "the client".

ARTICLE 2 : ORDERS
Orders may be placed by email: cine.scale@gmail.com, or online: http://www.cine-scale.com, as well as by mail: Cine-Scale, Domaine de Laumede, 46800 Montlauzun, France. We do not take order by phone at this time.
For flying models, an order form including a quotation will be sent by email or hand held to the client. This document will state the models specifications, its options, the applicable rates, and a non liable lead time estimate. The signature of the order form or the remittance of a downpayment act as a validation of the order and a full acceptance of the present general terms of sales.

ARTICLE 3 : PRODUCTS AVAILABILITY
Cine-Scale designs, builds, and sells scale rc helicopters accessories worldwide. We do our best to get you the shotest lead time and the fastest delivery. Delivery time frames highly depends of the nature of the order, these may start from 3 working days for pre-listed simple items up to 1 month for a new complex scale accessory creation. Regarding the flying models, the lead time are generally longer, due to the building complexity and the time-consuming finish. The time estimate mentionned into the order form is at its names indicates, an approximation of the time required to complete the models construction. This timeframe can in no ways be considered as a deadline, no delay penaltly can be claimed by the client. However, if for any reason a delay may appear, we would do our maximum to contain it to its strict minimum, and we could offer an additionnal feature to model, free of charge. This alternative is not systematic and can't be considered as a due.
ARTICLE 4 : PRICES
All prices are in euros. They are french VAT excluded, and without shipping charges. If you are an individual living within the European Union (EU), you will be charged of the current french VAT rate. If you are within the EU, but ordering as a company with a valid VAT number, you can be charged VAT free. If you are living outside of the EU, you will always be charged VAT free. Those indicated in another currency are given as an indication only. Prices are subject to modification without notice. Items will be charge at the rate displayed on our website on the day the order was placed. All orders are invoiced in euros and have to be paid in euros. For all delivery outside of France, the eventual custom fees and local taxes involved are supported by the client.

ARTICLE 5 : SHIPPING CHARGES
Shipping charges includes a handling and packing fee. They are defined by item category, depending of their size, weight and destination. Only the geographic area and the shipping mode selected by the client are changing the shipping charge. We recommend you to optimize the shipping by grouping your items on the same order.

ARTICLE 6 : PAYMENT
You can choose between several payment types which are offering a maximum of warranty and safety. You can pay by: 1. Online secured payment with Paypal, directly on our website, 2. Bank transfer (please send us an email indicating you wish to proceed this way, we would reply to you with our bank account information). 3. By check in euros, cashable in a french bank, to the order of Cine-Scale, 4. Money transfer, thru your local post office (therefore, use our adress: Cine-Scale hélicoptères, Domaine de Laumede, 46800 Montlauzun, France. Checks are will be cashed the day of the goods release.
Regarding the flying models, the payment can be either a full payment at the order, due to the amount of spares, accessories and powerplant, or with the following breakdown: 60% of downpayment at the order form signature, 20% payment complement, before the painting and the 20% remaining balance at the model delivery. Downpayments are not refundable.

ARTICLE 7 : DELIVERY
Whereever your are, we can deliver to your door. The shipping time includes the packing and the shipping. The average is 48 hours for France. This is the typical duration claimed by the national post. Cine-Scale can't be accountable for any delay in the delivery due to the carrier mishandling.
Warning: if you choose to pay by check, the order will be processed starting from the check reception.
For flying models, the shipping requires the manufacturing of custom sized boxes, and an insurance is subscribed to cover the risk of the handling and transportation. Should you decide to get hold of your goods in our workshop, a simple phone call to take an appointment in fine.

ARTICLE 8 : WARRANTY
Cine-Scale offers 2 disctincts products family:

1) Accessories and spare parts:
Cine-Scale accessories are new and have a warranty against any misshape and/or default. Should an item be defective or misshaped, we will exchange it free of charge after reception of the original goods, in its orginal packing with the matching invoice, within 7 days following parcel reception. The return shipping charges remains to be supported by the client. Adress: Cine-Scale, domaine de Laumede, 46800 Montlauzun, France.
Due to the very specific nature of each scale model, Cine-Scale can't guarantee the full compatibility of its accessories when the assembly and installation are done by the client himself.

2) Flying models: Cine-Scale, does not offer a warranty for its flying models. Theses are delivered to our clients only after a probabation hovering flight. However, as rare as it could be, a mechanical or an electronic issue is still possible; the client who orders a ready to fly, turn-key helicopter accept the potential risk without considering any liability of Cine-Scale, or any of its coworkers or contractors. Should an issue happen before the delivery, Cine-Scale will fully support the relevant costs and only in this situation. Some equipments like gas turbines are requesting a maintenance on a regular basis. Please keep in mind to service them following the manufacturer's specificiations, to avoid loosing your turbine warranty.
ARTICLE 9 : OWNERSHIP TRANSFERT - RISK TRANSFERT
The ownership transfer from Cine-Scale to the client, will only be effective after full payment completion, regardless of the date of delivery. However, the transfer of the risks of loss and damage will be effective to the client when the client signs the delivery form. During a delivery of a flying model, the client can take as long as he wishes to inspect the model, and to specify all correction and/or adjustments he feels necessary, before accepting the model. Once the model accepted and received as it, no further alteration could be requested as a warranty claim.

ARTICLE 10 : PERSONAL DATAS PROTECTION
The information which are being asked to you are necessary to process your orders. The storage of your datas is being done according to the law about information technology, datas and freedom from January 6th 1978. You own the right to access and to correct your personal datas. You just need to contact us (indiquating your name, first name, adress and email), by email at cine.scale@gmail.com
ARTICLE 11 : RESPONSABILITY AND LOCAL REGULATIONS
The products proposed are complying with the current french regulations. Cine-Scale decline any liability if the purchased and delivered item isn't complying with the client's local regulation (transmission frequency bands, specific provisions, local licence requirements...). We strongly advise the client to seek for information about the use of our products in his own country.

ARTICLE 12 : APPLICABLE RIGHT
All provisions listed into the present general terms of sales, as well as all transactions herein described are subject to the french right, the relevant courts are the ones from Cahors.

ARTICLE 13 : BUYER'S ACCEPTANCE
By the partial payment, as an order downpayment, or by the full payment completion, the client states that he fully agrees and accepts the rates and the general terms and conditions of sales, and declares having its entire knowledge, then renounce to rely on any opposite document, and especially his own general terms of purchase, the purchase act causing the full acceptance of the present general terms of sales.
The current general terms of sales are due to modification at any time without notice.

SAFETY RECOMMENDATIONS

Radio control helicopters are NOT toys and can not be considered as harmless. When operating flying scale models, you must apply safety rules and common sense, from which we give you, as and indication only, some elements:

• Just dont fly your model if your flying skills are not proficient enough. If you are questioning yourself about your current skills, contact us, we will guide you.
• Always practice in an appropriate area, this means a location where flying r/c models is legal, a wide open space without obstacles nor residences, without potential forest fire hazard.
• If your model is turbine powered, always keep a CO2 extinguisher handy. Handy means at the reach of your hand, not in the trunk of your car. Please make sur this is fully operational and still enough loaded.
• Watch out for the rotor blades, scale models have a larger rotor diameter than those you may be used to, keep your legs away from the blades tips when walking close to the model.
• Gas turbines have a typical exhaust temperarure about 1200°F. Stay away from the exhaust when the turbine is up and running, and also during the next 5mn following the turbine shut-down.
• Dont let your kids and/or pets unattended when you are flying.
• Store your jug of kerosene or petrol away from any heat, source of ignition or direct sunlight.
• Only use fresh, 100% moisture free kerosene or petrol (no fuel waste recycling or tank tails).
• Don't smoke when you are refueling.
• Should you have a doubt about the proper operation of a parts or an equipment, use common sense and a precautionary princip: do not fly and double check so see what's going on. If you realize that your are reaching your knowledge and experience limits, ask for some help from a seasoned modeller. It is always better to prevent, than learn the hard way you should have been preventing.
• Check the healthe of all your batteries, on a regular basis.
• Use dual power supply, and when this is technically possible, use redundant receiver systems, thus increasing your protection against bad luck.
• If you are using an electronic flybarless system, always let the unit to self initialize during the boot sequence, and confirm the init before moving the model.
• Don't use PPM, use better, 2.4Ghz.
• Perform a range check everytime you made a change into the model structure, mechanically and electronically. This has to be done with the engine up and running. Scale models are using a lot more cables, and electronic devices than a conventional training model. The use of a turbine engine increases the complexity of the onboar electronic. The coexistence of all theses devices is not 100% garanteed, and a range test may help you to know whether everything is nominal, and for example, to see if a simple change in the kerosene pump mount is affecting the reception quality.
